Terms of use

1. Who we are

WillCloud is a digital product operated by FCG Financial Services Pty Ltd (ACN 635 012 396, ABN 38 635 012 396) of Ground Floor, 345 Ann Street, Brisbane QLD 4000, Australia (we, us, our).

These terms govern your use of app.willcloud.com.au, related WillCloud websites and applications, and the services we provide through them (together, the Service).

2. Not legal advice

We are not a law firm. WillCloud does not provide legal advice, financial advice, or a solicitor–client relationship. A will generated or stored through the Service is based on information you supply. You should obtain independent legal advice where you need it, including about whether a document meets the formal requirements in your State or Territory.

3. Availability

The Service is being prepared for general release. Until we open accounts to the public, these pages exist so you can identify us and read these terms and our Privacy Policy. Features described here may not yet be available.

4. Using the Service

When the Service is available, you must:

We may suspend or close access if we reasonably believe these terms have been breached, if we are required to do so by law, or to protect the Service or other people.

5. Identity verification

Some features (including creating an account, signing a will, or acting as a witness) may require identity verification. We use independent providers, including Sumsub, to collect and check identity documents and biometric information. By starting a verification you also agree to that provider’s terms for the check. We may refuse or delay a feature until verification succeeds.

6. Payments

Paid plans and related fees (if offered) are charged in Australian dollars through Stripe. Prices, what a plan includes, and refunds (subject to the Australian Consumer Law) will be shown before you pay. Payment card data is handled by Stripe, not stored by us as full card numbers.

7. Your content

You retain your rights in the information, documents, images, and recordings you submit. You grant us a licence to host, process, and display that material solely to operate the Service (including sharing it with people you invite, such as witnesses, executors, or a solicitor, and with our processors). You must not upload material that you do not have the right to use.

8. Intellectual property

The WillCloud name, logos, software, and site design are owned by us or our licensors. These terms do not transfer those rights to you.

9. Privacy

We handle personal information as described in our Privacy Policy.

10. Liability

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other laws that cannot be excluded.

To the extent permitted by law, we are not liable for loss that is indirect or consequential, or for loss of profit, data, or opportunity, arising from your use of the Service. Where our liability can be limited, it is limited to resupplying the Service or paying the cost of having it resupplied.

You are responsible for keeping your own copies of important documents. Internet transmission is not guaranteed to be error-free.

11. Changes

We may update these terms by publishing a new version on this page. The “Last updated” date will change. Continued use after a change is an acceptance of the new terms. If you do not agree, you must stop using the Service.

12. Governing law

These terms are governed by the laws of Queensland, Australia. The courts of Queensland (and the Commonwealth of Australia) have non-exclusive jurisdiction.
